Caramelooser respects the intellectual property rights of others and is committed to complying with the provisions of the Digital Millennium Copyright Act (DMCA). This policy outlines our procedures for responding to notices of alleged copyright infringement and our process for removing or disabling access to infringing material.

Reporting Copyright Infringement: If you believe that your copyrighted work has been infringed upon on our website, please notify us by providing a written notice (“DMCA Notice”) that includes the following information:

  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Response to DMCA Notices: Upon receipt of a valid DMCA Notice, we will take appropriate action, which may include removing or disabling access to the allegedly infringing material. We will also promptly notify the alleged infringer of the DMCA Notice and provide them with an opportunity to submit a counter-notification.

Counter-Notification: If you believe that your material has been removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our designated copyright agent. The counter-notification must include the following:

  1. Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled.
  2. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or the federal district courts located in [City, State] if your address is outside of the United States), and that you will accept service of process from the person who provided the DMCA Notice or an agent of such person.
  4. Your physical or electronic signature.

Submitting a Counter-Notification: Counter-Notifications should be sent to our designated copyright agent at the address provided above.

Repeat Infringers: We reserve the right to terminate the accounts of users who are repeat infringers of copyright.
